Yes, foreigners can buy property in Malta. The rules depend on where the property is and on the buyer’s residence history. In practice there are two routes: buying inside a Special Designated Area, or buying elsewhere with an Acquisition of Immovable Property (AIP) permit.

What are Special Designated Areas?

Special Designated Areas (SDAs) are approved developments where buyers of any nationality can purchase property on the same terms as Maltese citizens. No AIP permit is needed, there is no limit on the number of properties, and owners can rent them out. Well-known examples include Tigné Point, Portomaso and SmartCity. SDAs are usually modern developments with services such as concierge, parking, pools and marinas.

How does the AIP permit work?

Outside SDAs, non-residents and EU citizens who have not lived in Malta for five continuous years generally need an AIP permit. The permit allows one property for the buyer’s own residential use, and the property must meet a minimum value set by law and updated periodically. The notary normally files the application as part of the purchase.

What does the buying process look like?

  • Agree the price and sign a promise of sale with a deposit
  • The notary carries out title and registry searches
  • Any AIP permit and financing are arranged
  • The final deed of sale is signed before the notary

Can property support a residency application?

Yes. Several Maltese residence and tax programmes require a qualifying property, rented or purchased, so the right choice depends on both your lifestyle and your residency plans.
